Terms & Conditions – Personal Training & Online Coaching

1. Payment Policy

  • All payments must be made in full prior to the start of any training sessions or programs.

  • All sales are final. No refunds will be issued once payment has been made.

2. Session Cancellations & Rescheduling

  • A minimum of 24 hours’ notice is required to cancel or reschedule an in-person or online training session.

  • Sessions canceled with less than 24 hours’ notice will be considered forfeited and will not be rescheduled or refunded.

  • The trainer reserves the right to reschedule sessions if necessary, with reasonable notice given to the client.

3. Expiration of Sessions

  • Pre-purchased sessions or packages must be used within the agreed-upon timeframe (outlined by the trainer at time of purchase). Unused sessions will expire and are non-refundable.

4. Liability & Assumption of Risk

  • Clients acknowledge that participation in fitness training carries inherent risks, including injury, illness, or other complications.

  • By signing the Liability Waiver, clients accept full responsibility for their own health and safety during training sessions (in-person or online).

5. Online Coaching Policy

  • Clients are responsible for ensuring they have a safe training environment when following online programs.

  • The trainer is not liable for injuries or accidents that occur outside of direct in-person supervision.

6. Commitment & Results

  • Results vary for each individual and depend on factors such as effort, consistency, and adherence to the program.

  • The trainer makes no guarantees of specific outcomes but is committed to providing guidance, support, and expertise.

Acknowledgment of Risk

I understand that participating in personal training, fitness programs, or online coaching involves physical activity that may include strength training, cardiovascular training, stretching, and conditioning exercises. I acknowledge that these activities carry inherent risks, including but not limited to:

  • Muscle soreness, strains, or sprains

  • Joint or back injuries

  • Cardiovascular complications

  • Other unforeseen risks

Assumption of Responsibility

I voluntarily assume all risks associated with participating in personal training sessions (in person or online) with my trainer. I agree that I am responsible for monitoring my own condition during exercise and will immediately stop and inform my trainer if I experience any pain, dizziness, or discomfort.

Medical Clearance

I confirm that I have completed the PAR-Q (Physical Activity Readiness Questionnaire) truthfully. If I have answered “YES” to any of the PAR-Q questions, I understand that I should seek medical clearance before participating in training.

Release of Liability

I hereby release, waive, and discharge my trainer, their business, and any associated parties from any and all liability, claims, demands, actions, or causes of action arising out of or related to any injury, loss, or damage sustained as a result of participating in training sessions or programs, whether conducted in person or online.

Consent for Online Training

I acknowledge that when training online, my trainer cannot physically supervise or spot me, and I take full responsibility for ensuring my exercise environment is safe and free from hazards.

Agreement

I have read and understood this waiver and fully agree to its terms. I sign this voluntarily and understand it is legally binding.

Terms & Conditions for Online Programs

1. General Disclaimer

By purchasing or participating in services from Drvn Performance, you acknowledge and agree to the following:

  • I am a Certified Personal Trainer (CPT), qualified to provide exercise programming, coaching, and fitness guidance.

  • I am not a licensed physician, medical professional, or registered dietitian/nutritionist. Nutrition coaching provided is for educational purposes only and should not be taken as medical or dietary prescription.

  • Nothing provided through this website, coaching, or related materials constitutes medical advice, diagnosis, or treatment.

  • You should always consult a licensed healthcare provider before beginning any new exercise, diet, or supplement plan.

2. Assumption of Risk

Participation in exercise, strength training, conditioning, and nutritional changes involves inherent risks, including injury, illness, or other health complications. By enrolling, you voluntarily assume all risks and agree to release Drvn Performance and its coaches from liability for injuries, health issues, or damages related to participation.

3. No Guarantees

While training and nutrition coaching can support performance and health, results vary. No guarantees are made regarding weight loss, muscle gain, performance improvements, or other specific outcomes.

4. Payments & Refunds

  • All purchases are final sale.

  • No refunds, cancellations, or transfers will be granted once a program has been purchased.

  • By enrolling, you agree to pay the full program or package fee.

5. Client Responsibilities

  • You must provide accurate health, fitness, and nutrition information.

  • You agree to follow instructions to the best of your ability and to communicate any injuries, illnesses, or concerns.

  • You understand that lack of effort, failure to follow the program, or withholding information may impact results.

6. Intellectual Property

All programs, materials, and resources are the property of Drvn Performance. They may not be copied, shared, or resold without written permission.

7. Limitation of Liability

To the fullest extent allowed by law, Drvn Performance is not liable for injuries, damages, or losses arising from participation in training or coaching services.

8. Governing Law

These Terms & Conditions are governed by the laws of BC, Canada.
